Environmental or Social Incident

Definition

Environmental or Social Incident will be defined on a case-by-case basis depending on the nature of the Project, and will include:

  • the release of any hazardous substance on or from any property of the Client;
  • any unanticipated incident, accident or circumstance in connection with the Project which has resulted in or is likely to result in significant, severe or irreversible damage to or impact on the environment, or damage, impact or harm to the lives, livelihood, quality of life, health, safety, security or property of any person; or
  • an incident or accident relating to the Client or the Project which has had the following direct or indirect impact in any of the categories specified:
    • on health: death, major disability or serious health damage;
    • on society: destruction of a site or object of cultural or religious significance, permanent, serious damage or destruction of community assets or infrastructure, or any significant and sustained community or worker-related grievance, protest, action or challenge to the Project; or
    • material damage to the Environment (including through the release of any Environmental Contaminant).
