Personal Loan Contract

From Open Risk Manual

Definition

Personal Loan Contract. The contract for a loan which is advanced to an individual human beings or two more individual human beings in their personal capacities.

Issues and Challenges

This originates from the terms in the PoC Semantic Data Model, which did not distinguish between personal and business loans, but for which a good number of the terms defined for "Loan" apply uniquely to personal loans and not to corporate loans, i.e. information about the borrower which can only be information about an individual. Therefore a separate class of Personal Loan Contract, and Personal Loan, have been defined here so that these facts may be applied at the level at which they are meaningful and relevant. In the case of loans to more than one individual, there is a "Co-borrower". It should be assumed that the two or more parties are jointly and severally liable for any liabillities incurred under the terms of this Contract.
